Lawsuit Updates – Masters Club & Eubanks

The number of hits I’m getting on the lawsuits indicate it’s about time to do an update.

The Masters Club LLC lawsuit is still chugging along. In case you are unaware Masters Club is the entity suing the town for the ability to put a strip club in the old Elks property on Roberts Street. Both sides recently agreed to change the judge to Garfinkle and the  town has filed a response to the Masters Club complaint. At this point I expect it will be March before the case moves along.

The Eubanks v. East Hartford case has had some developments. In this case Mr. Jermayne  Eubanks is suing the town and members of the Police for his arrest back in 2006 where he complains he was wrongly arrested and was a victim of police brutality. Mr Eubanks decided a change in lawyers would be a good thing and hired Wayne Francis who is not unfamiliar to East Hartford with a handful of successful assessment challenges and foreclosure defenses. This is not the same type of case however. The town has been active as well filing a motion to dismiss (2,3,4) on the grounds that some of the charges are beyond the statute of limitations and those charged are not liable for any misconduct.

You may also recall I reported that Masters Club LLC had filed a zoning appeal appealing the change which removed special permit requirements for adult businesses opening up all I-3 zones as permitted use zones for adult businesses.
The appeal has had little activity with a continuance granted to the Masters Club the next activity will be a status conference on Jan. 20th followed by a hearing on March 25th.

The Masters Club v. Elks suit is moving along slowly as well. Masters Club has amended it’s original complaint, but I have not been near a courthouse in awhile.

    Um, that Master Club link is so not related to the “Masters Club,” it’s actually quite funny.
